Danae Azaria | The Six Stories about State Silence

18 May 2021
Hebrew University Jerusalem (Online)
Dr Azaria discussed ‘Six Stories of State Silence’, which appear in the forthcoming edited volume on State Silence Across International Law, and set the framework of her research agenda about the contexts in which State silence is given legal meaning and legal effect in international law-making taking into account the modern realities and modern features of international law, where 190 States exist, communications are easier, more permanent fora of cooperation exist, more non-State actors claim a position in the international law-making process, and where not only bilateral/reciprocal obligations exist, but also community interests and hierarchically superior norms have emerged. What is the role of State silence against such settings? Is State silence a guarantor of legal stability or an enabler of change in international law?
